Terms of Service

These Terms of Service govern access to and use of KOLab. Please review them carefully before using the platform.
1. Eligibility
You must be at least 18 years old and legally able to enter into binding agreements to use KOLab. If you use KOLab for a business or agency, you represent that you have authority to act for that entity.
2. Account Registration
You must provide accurate information during registration and keep your account details up to date. You are responsible for your login credentials and activities carried out through your account.
3. Account Security
KOLab will never ask you for your password, social media login credentials, payment card details, OTP codes, or any other sensitive authentication information via email, direct message, chat, phone, or any communication channel. If anyone claiming to represent KOLab asks for such information, do not respond and report it immediately to security@kolab.my. KOLab staff and automated systems only authenticate users through the official login page on the platform.
4. Platform Roles
KOLab supports creator and brand use cases. KOLab may determine, modify, limit, or remove account roles, feature access, profile visibility, verification eligibility, and boost eligibility at its sole discretion. Features may differ depending on your account setup, profile status, verification state, purchase history, and platform rules in effect at the time.
5. Acceptable Use
You must not post false information, impersonate another person or business, manipulate metrics, misuse messaging tools, scrape the platform, or use KOLab for unlawful, misleading, abusive, fraudulent, threatening, harassing, hateful, defamatory, obscene, or otherwise harmful conduct. This restriction applies to all profile content, social account details, usernames, bios, portfolio items, uploaded images, captions, links, URLs, messages, campaign materials, and any other content or metadata you submit to KOLab. Display names must not contain illegal, hateful, discriminatory, sexually explicit, violent, threatening, or misleading terms, or impersonate other individuals, brands, or organizations. KOLab reserves the right to reject, reset, or modify any display name that violates these terms without prior notice.
6. Content and Profile Information
You retain ownership of the content you upload. By publishing content on KOLab, you grant KOLab a non-exclusive right to host, display, reproduce, format, distribute, and use that content for platform operation, discovery, promotion, moderation, enforcement, and service improvement. You represent and warrant that you have the rights, permissions, consents, and authority necessary to upload or publish that content, and that the content does not infringe third-party rights, violate law, breach any confidentiality or contractual obligation, or include illegal, abusive, threatening, harassing, hateful, deceptive, malicious, sexually explicit, or otherwise harmful material. You must not use social account fields, portfolio uploads, profile text, images, or URLs to promote unlawful activity, target or abuse other people, spread malware, phishing, scams, or spam, or otherwise misuse KOLab. KOLab may review, remove, disable, or restrict such content or related account access at its discretion where it considers this necessary for user safety, policy enforcement, legal compliance, or platform integrity. Portfolio items are limited to a maximum of 10 per account. Portfolio URLs must link to genuine, publicly accessible content that you own or have permission to share; you must not submit URLs that lead to illegal, malicious, phishing, or spam content. Where KOLab asks for uploaded thumbnails or media, you are responsible for uploading lawful files that you own or are allowed to use. KOLab may reject, replace, crop, compress, or remove thumbnails, media, external image URLs, or broken links where needed for security, reliability, display quality, or legal compliance.
7. Creator and Brand Responsibility
Creators and brands are responsible for their own negotiations, deliverables, timelines, compliance disclosures, pricing, invoices, taxes, and campaign performance commitments unless KOLab expressly states otherwise in a separate written agreement. A campaign, booking request, application, or collaboration status shown in KOLab is a workflow aid and does not by itself prove that legal, tax, advertising disclosure, platform policy, payment, or deliverable obligations have been satisfied. If a creator and brand communicate, negotiate, settle, contract, or make payment arrangements privately or outside KOLab, KOLab is not a party to that arrangement and is not responsible for any loss, dispute, non-payment, misconduct, cancellation, refund claim, or failure of performance arising from that off-platform dealing.
8. Campaigns, Bookings, Collaborations, and Messages
KOLab may provide campaign listings, creator discovery, media kits, booking requests, inquiries, direct messaging, application workflows, and collaboration tracking. Campaigns may move through creation, activation, application review, shortlisting, acceptance, and completion states. Bookings may move through request, creator response, acceptance, decline, and follow-up states. Accepted campaign applications or accepted bookings may be linked to collaborations, where users can track agreement, content submission, review, revision, and completion. A campaign or booking being accepted or marked complete does not necessarily mean that deliverables have been approved, payment has been made, or all obligations have been fulfilled. KOLab may review, refuse, remove, limit, reorder, or disable campaigns, bookings, applications, collaborations, profiles, or messages where it considers this necessary for policy enforcement, safety, quality control, legal compliance, or platform integrity. KOLab does not guarantee campaign outcomes, response rates, collaboration completion, payment, or commercial results from platform usage.
9. Pricing, Boosts, and Paid Features
KOLab may offer one-time paid boosts, vouchers, extended slots, or other paid features. KOLab may set, revise, suspend, or withdraw pricing, duration, availability, eligibility requirements, placement logic, and feature scope at any time. Unless stated otherwise, paid features are non-transferable, non-refundable, and do not guarantee any minimum reach, ranking position, campaign result, booking result, collaboration result, or business outcome except where refund is required by applicable law. You are responsible for any taxes, payment processing issues, chargebacks, or invalid payment methods associated with your purchase. KOLab may refuse, reverse, cancel, withhold, or remove paid placement or access where payment is reversed, disputed, unauthorized, suspected to be fraudulent, or otherwise not successfully settled.
10. AI Assistant and Automated Features
KOLab may provide AI-assisted features, automated summaries, recommendations, workflow guidance, content suggestions, or support responses. AI and automated outputs are provided for convenience only and may be incomplete, outdated, inaccurate, or unsuitable for your circumstances. You are responsible for reviewing outputs before relying on them, and you must not treat them as legal, tax, financial, accounting, professional, or guaranteed business advice. KOLab may monitor, limit, improve, or disable AI-assisted features to maintain quality, safety, compliance, and platform integrity.
11. Privacy, Personal Data, and Security
KOLab processes personal data in accordance with its Privacy Policy and applicable Malaysian personal data protection requirements. You agree not to submit unnecessary sensitive personal data, third-party personal data without authority, payment credentials, identity documents, or confidential information through public profiles, portfolio items, campaign materials, messages, AI prompts, or support requests unless KOLab expressly requests it through an appropriate secure workflow. KOLab may take steps to prevent, investigate, respond to, and notify relevant parties or authorities about security incidents, personal data breaches, unlawful content, or platform misuse where required or permitted by law.
12. Reports, Moderation, and Online Safety
KOLab may provide reporting tools for suspected fake accounts, impersonation, scams, harassment, abusive content, illegal content, misleading activity, intellectual property issues, or safety concerns. KOLab may moderate content, restrict features, preserve records, cooperate with service providers or authorities, and take action against accounts or content where it considers this necessary under platform rules, Malaysian law, online safety expectations, or user protection needs. You must not use KOLab to target minors, exploit people, distribute sexual or violent abuse material, promote self-harm, conduct financial fraud, spread malware, coordinate harassment, or publish unlawful harmful content.
13. Verification and Official Status
Any official, verified, featured, admin, boost, ranking, or other platform status shown on KOLab is determined solely by KOLab. KOLab has the right to grant, deny, remove, suspend, or change such status at any time, with or without notice, where it considers appropriate. Users must not claim platform affiliation, official status, endorsement, or guaranteed visibility without authorization.
14. Suspension and Termination
KOLab may investigate activity and may suspend, restrict, remove content, limit visibility, disable messaging, reject campaigns or applications, or terminate access if you violate these Terms, create legal or safety risk, misuse the platform, submit false or misleading information, or otherwise create risk to users, partners, or platform operations. Except where prohibited by law, KOLab may take such action at its discretion and is not required to provide advance notice.
15. Indemnity
You agree to defend, indemnify, and hold harmless KOLab, its affiliates, officers, employees, and service providers from claims, losses, liabilities, damages, costs, and expenses, including reasonable legal fees, arising out of your content, your use of the platform, your dealings with other users, your breach of these Terms, or your violation of law or third-party rights.
16. Disclaimers
KOLab is provided on an 'as is' and 'as available' basis. We do not warrant uninterrupted availability, error-free operation, campaign success, creator authenticity beyond platform checks, or suitability for any specific business purpose. KOLab acts as a platform operator and, unless expressly stated otherwise in a separate written agreement, is not the employer, agent, partner, guarantor, escrow provider, or contracting party for creator-brand arrangements.
17. Limitation of Liability
To the maximum extent permitted by law, KOLab is not liable for indirect, incidental, consequential, special, punitive, or business loss damages arising from use of the platform. To the extent a limitation amount is required to make this clause effective, KOLab's aggregate liability relating to the platform or paid features will not exceed the amount you paid to KOLab for the specific paid feature giving rise to the claim during the twelve months before the event giving rise to liability, except where a different amount is required by applicable law.
18. Changes to the Platform or Terms
KOLab may modify, replace, suspend, or discontinue any part of the platform, and may update these Terms from time to time. Continued use of KOLab after an updated version takes effect constitutes acceptance of the revised Terms, except where applicable law requires additional notice or consent.
19. Governing Law
These Terms are governed by the laws of Malaysia. Any dispute relating to KOLab will be subject to the applicable courts or legal forums in Malaysia, unless mandatory law requires otherwise.
